Which law governs hospital billing in Rajasthan?

Under the Clinical Establishments Act framework, hospitals, nursing homes, clinics, and diagnostic labs must register with the designated registering authority (typically constituted at the district level), meet prescribed minimum standards, and display the rates they charge for services. If the bill charges more than the displayed rate for the same service, that discrepancy is a concrete, documentable complaint rather than a vague feeling of being overcharged.
The Act does not fix what hospitals may charge. It regulates registration, standards, and transparency. What is unique about Rajasthan?
Rajasthan passed the Rajasthan Right to Health Act in 2022, the first state right-to-health law in India. No other state gives patients a statutory right of this kind, and it changes the balance in two ways that matter for billing disputes.
First, the Act guarantees emergency treatment at private hospitals without prepayment. In most of India, the demand for a deposit before an emergency admission is a norm patients cannot fight in the moment. In Rajasthan, a private hospital that refuses to stabilise an emergency patient until money is paid is acting against state law. Second, the Act creates grievance redressal mechanisms for violations of the rights it guarantees. Which government scheme rates apply in Rajasthan?
Three rate references are useful for checking a Rajasthan hospital bill, depending on how you were treated.
Mukhyamantri Ayushman Arogya Yojana (earlier Chiranjeevi). This is Rajasthan's flagship state health cover. Empanelled hospitals treat eligible families cashless at fixed package rates. If your treatment ran under the scheme, the package rate is not a benchmark — it is the price. PMJAY (Ayushman Bharat). Rajasthan's scheme operates alongside the central PMJAY architecture, and PMJAY's Health Benefit Package rates cover more than 1,500 procedures with published prices. CGHS rates, adjusted for city tier. Jaipur is a Y-tier CGHS city, which means CGHS reference rates there are 10 percent below the standard X-tier rate. Consumer forums increasingly treat CGHS rates as a reasonableness benchmark for private bills, so a Jaipur bill running three or four times the Y-tier CGHS rate for the same procedure is a strong talking point. For medicines and devices, NPPA ceiling prices apply in Rajasthan exactly as they do everywhere in India. Scheduled drugs, coronary stents, and knee implants have legally binding ceilings, and charging above them is enforceable overcharging, not a matter of negotiation.

- District Consumer Disputes Redressal Commission. For a refund or compensation, file a consumer complaint in the district commission for your district. - NPPA, for drug and device overcharges. If any medicine, stent, or implant was billed above its ceiling price, complain to the National Pharmaceutical Pricing Authority. This runs in parallel with everything above and is the one route where the price cap itself is legally enforceable.
