Hospital Bill Rights in West Bengal: State Laws, Complaint Bodies & How to Dispute
If a hospital bill in Kolkata or anywhere in West Bengal looks wrong, you have more direct options than patients in most Indian states. This page explains the state law, the commission that hears billing complaints, and the exact order to escalate in.
A large hospital bill lands at the worst possible moment. Someone you love is unwell, discharge is being held up, and a bill you cannot fully read is sitting between you and going home. If that is where you are right now, take a breath. In West Bengal, the law is more clearly on your side than in almost any other state, and there is a defined path for questioning a bill, both before you pay and after.
Across India, patients rely on a patchwork of benchmarks and consumer forums to challenge hospital charges. West Bengal added something most states never did: a dedicated state commission that hears billing complaints directly. This page walks through what that means in practice.
Which law governs hospital billing in West Bengal?
Private hospital billing in West Bengal is governed by the state's own law: the West Bengal Clinical Establishments (Registration, Regulation and Transparency) Act, 2017. West Bengal did not simply adopt the central Clinical Establishments Act 2010; it passed its own, stronger statute, and the word "Transparency" in the title is doing real work.
The 2017 Act requires private clinical establishments in the state to register with the state authority as a condition of operating, and it builds patient-facing transparency into that registration. In concrete terms, the framework the Act creates supports the things patients most often need in a billing dispute: knowing what a hospital charges, receiving a bill you can actually itemise and question, and having a named state body with jurisdiction over the establishment.
Most importantly, the Act creates the West Bengal Clinical Establishment Regulatory Commission (WBCERC), the body the next section covers. If you have not yet obtained a fully itemised bill from your hospital, do that first; our guide on how to read a hospital bill explains what a complete itemised bill must show and how to ask for one.
What is unique about West Bengal?
The WBCERC is the unique lever. Created under the 2017 Act, the West Bengal Clinical Establishment Regulatory Commission is one of the only state bodies in India with the power to hear billing complaints against hospitals directly and to order compensation. In most states, a patient disputing a bill has essentially one formal destination: the district consumer forum, with its filing formalities and long timelines. In West Bengal, there is a billing-specific commission sitting above the hospitals themselves.
Why does that matter so much? Because it changes the negotiation before you ever file anything. A billing department in Kolkata knows that an aggrieved patient does not have to wait a year for a consumer forum hearing; they can take an itemised bill straight to a commission whose whole remit includes exactly this. That knowledge alone makes hospitals in West Bengal more responsive to a well-documented, line-item dispute than hospitals in states where the only threat is distant litigation.
For patients elsewhere, the equivalent levers look different: Karnataka relies on the KPME Act's itemised-billing mandate, and Rajasthan has its Right to Health Act. West Bengal's version is arguably the most direct of them all, because the WBCERC can put money back in your hands, not just direct the hospital to behave.
Which government scheme rates apply in West Bengal?
Three rate benchmarks matter for a West Bengal bill: Swasthya Sathi, PMJAY, and CGHS. None of them legally caps what a private hospital may charge a cash patient, but each is a recognised reference for what a fair price looks like, and each is usable in a dispute.
Swasthya Sathi is West Bengal's own scheme, and it is unusual in being universal and fully state-funded. Hospitals empanelled under Swasthya Sathi accept the scheme's package rates for covered procedures. If your hospital is empanelled and charged you, as a cash patient, several times the package rate it accepts from the scheme for the same procedure, that gap is a fair question to put to the hospital, and to the WBCERC.
PMJAY (Ayushman Bharat) package rates apply at hospitals empanelled under the central scheme and serve as a second reference list, with over 1,500 priced procedures.
CGHS rates are the benchmark courts and forums cite most often. Kolkata is an X-category (top-tier) CGHS city, which means the full standard CGHS rate applies with no city discount. Our guide to CGHS rates explained covers how to look up the rate for your exact procedure.

Get my bill checkedWhat billing patterns should patients in West Bengal watch for?
Kolkata's private hospital market is dominated by large corporate chains, including Apollo, Fortis, and Manipal (which took over the former AMRI hospitals). Chain hospitals bill through standardised systems, which cuts both ways: bills are usually well itemised, but the same structural patterns seen in corporate billing across India appear here too, such as consumables billed line by line at MRP, non-payable items passed to the patient at discharge, and package-versus-itemised ambiguity.
Before settling any large bill in West Bengal, ask for the fully itemised bill, compare procedure lines against CGHS Kolkata (X-tier) rates, check drug lines against NPPA ceiling prices, and if the hospital is Swasthya Sathi-empanelled, ask what the scheme package rate for your procedure is. Discrepancies you find at this stage are far easier to resolve than after payment.
Where do I complain about a hospital bill in West Bengal?
Escalate in this order. Each step creates the paper trail the next step needs.
- Hospital grievance redressal officer (GRO). Put your dispute in writing to the hospital's own grievance cell first, with the itemised bill and the specific lines you contest. Keep a dated copy. Our guide on how to dispute a hospital bill includes the letter structure.
- West Bengal Clinical Establishment Regulatory Commission (WBCERC). If the hospital does not resolve it, complain to the WBCERC under the 2017 Act. This is the state's distinctive step: the Commission can hear the billing complaint directly and order compensation.
- State registering authority. Registration under the 2017 Act is a condition of operating, so persistent non-compliance with the Act's transparency requirements can also be raised with the registering authority as a licensing matter.
- District Consumer Disputes Redressal Commission. The consumer forum route under the Consumer Protection Act 2019 remains open, particularly for deficiency-of-service claims alongside overbilling.
- NPPA, for drug and device overcharges. If a medicine or device (such as a stent or knee implant) was billed above its government ceiling price, that is a separate violation reportable to the National Pharmaceutical Pricing Authority regardless of everything above.
Who can help me locally in West Bengal?
If you need free legal help, the District Legal Services Authority (DLSA) in your district provides free legal aid to eligible applicants and can help draft and file complaints; there is a DLSA in every district of West Bengal. For consumer-rights guidance in multiple languages, the National Consumer Helpline is available on 1915 and can register your grievance against the hospital directly. Both services are free, and neither requires a lawyer to get started.

Frequently Asked Questions
Can I complain directly to the WBCERC about a hospital bill?
Yes. The WBCERC, created under the West Bengal Clinical Establishments (Registration, Regulation and Transparency) Act 2017, hears billing complaints against private clinical establishments directly and can order compensation. You do not have to start in a consumer forum, though that route stays open too.
Does the 2017 Act apply to all private hospitals in West Bengal?
It applies to private clinical establishments covered by the Act's registration requirement, which includes the large corporate hospitals in Kolkata such as Apollo, Fortis, and Manipal. Government hospitals follow departmental grievance channels instead. Registration under the Act is a condition of operating.
What CGHS tier is Kolkata, and why does it matter for my bill?
Kolkata is an X-category CGHS city, the top tier, so the full standard CGHS rate applies with no city discount. That makes the published CGHS rate for your procedure directly comparable to what a Kolkata hospital charged you, without any adjustment arithmetic.
Does Swasthya Sathi cap what a hospital can charge me as a cash patient?
No. Swasthya Sathi package rates bind empanelled hospitals only for scheme beneficiaries. But if the same hospital accepts the scheme's rate for your procedure from the state and charged you several times that amount in cash, the gap is a legitimate point to raise with the hospital and, if needed, the WBCERC.
Should I go to the WBCERC or the consumer forum first?
They are separate remedies and using one does not close the other. Many patients raise the billing dispute with the WBCERC first because it is billing-specific, and keep the district consumer commission available for deficiency-of-service claims.
