Which law governs hospital billing in Maharashtra?
Private hospitals and nursing homes in Maharashtra are regulated under the Bombay Nursing Homes Registration Act, a state law. Maharashtra did not adopt the central Clinical Establishments (Registration and Regulation) Act, 2010, so the framework that applies in states like Uttar Pradesh or Jharkhand does not apply here. What does this give you as a patient, concretely? Three things. First, every nursing home and private hospital must be registered with the local authority, typically the municipal corporation's health department in cities like Mumbai and Pune. Second, the general consumer-law right to an itemised bill applies fully in Maharashtra: you can demand a break-up of every charge before paying. - The local registering authority. Not for covered packages at an empanelled hospital. MJPJAY treatment is cashless for eligible beneficiaries, and demanding payment for a covered package is a violation reportable to the scheme grievance cell. Hospitals sometimes bill beneficiaries for items they claim fall outside the package, so ask for the package definition in writing and verify each extra charge against it.
